FIBA Arbitral Tribunal: 1813/22 (Brantley v/ Basketball Club Unics)

Summary of the Case:

The American player Jarrell Isaiah Brantely filed a claim against the Russian club Basketball Club Unics for outstanding salaries, compensation, airfare reimbursement, tax certificate and interest. The Claimant submitted that the Respondent breached the employment agreement by terminating it without just cause after the Claimant had left the Respondent due to the implications of the Russian invasion in the Ukraine. The Respondent argued that 1) the termination was with just cause because the Claimant's departure constituted a breach of the employment agreement, since the requirements of the force majeure clause stated in the agreement were not met and that 2) the Respondent's termination of the agreement was not causal for the damages allegedly suffered by the Claimant. The claim was partially upheld.
